What Is A Will?

A will is a document where you state how you want your stuff to be distributed after you die.

It can also include who should take care of your children (if they are still young).

The will names an executor to make sure these wishes are followed.

If you don’t have a will, the government decides how to distribute your things.

What Does An Attorney For Wills In Chestatee Do?

In Chestatee, an attorney for wills has several important roles:

  1. Writing Wills: We make wills that clearly say who gets your stuff, helping avoid family arguments and giving you peace of mind.
  2. Giving Advice: We explain how to plan your stuff the right way, following Georgia’s rules. This keeps things simple and legal for you.
  3. Setting Up Trusts: We set up trusts that protect your money from too much tax, people who owe you money, or lawsuits.
  4. Changing Wills: When big things in your life change, we quickly update your will. This makes sure it always says what you want.
  5. Helping with Probate: We make the probate process easier after you’re gone. This makes sure your will is followed correctly.
  6. Making Important Documents: We write papers that let someone you trust make decisions about your money or health if you can’t.
  7. Protecting Your Assets: We advise on how to keep your money and property safe. This helps your family in the long run.
  8. Reducing Taxes: We find ways to lower the taxes when you give away your money or stuff, so your family gets more.
  9. Solving Problems: If people argue about your will, we help sort it out. This makes sure that what you want happens.
  10. Assisting with Donations: If you want to give money to charities in your will, we help you do that. This way, you can help others even after you’re gone.

The Benefits Of Having A Will Set Up

Is getting a will even worth the investment?

A will is an investment into your family’s future.

You’re making sure they are taken care of after you’re gone.

Here are some of the key advantages:

  1. You Decide Who Gets Your Stuff. A will lets you choose who gets your things when you’re not here anymore. Without a will, the law decides who gets what, and it might not be what you want.
  2. Keeping Your Family Safe. You can make sure your family, especially kids or people who aren’t good with money, are taken care of the way you want.
  3. Picking Someone to Handle Your Things. A will lets you choose someone you trust to make sure your wishes are followed after you pass away.
  4. Less Fighting in the Family. A will makes it clear what you want to happen, so there’s less chance your family will argue about it.
  5. Who Looks After Your Kids. If you have young kids, you can say who you want to take care of them in your will.
  6. Making Things Easier and Quicker. With a will, sorting out your stuff after you’re gone can be faster and cost less in legal fees.
  7. Saving on Taxes. A good will can help your family pay less in taxes on what they inherit from you.
  8. Giving to Charity. If you want to leave money to a charity, you can put that in your will.
  9. Peace of Mind. Knowing you have a will can make you feel better because you know everything will be handled the way you want.
  10. Changing It When You Need To. You can always update your will if things in your life change.

What Happens If You Don’t Set Up A Will?

Now, you know setting up a will is worth the investment.

But it’s also important to know what happens when you don’t have a will.

And how your family will be affected once you pass and leave them to deal with it.

Here is what happens when you don’t have a will:

  1. The Law Decides Who Gets Your Stuff. Without a will, the government makes the rules about who gets your things. This might not match what you would have wanted.
  2. It Could Cause Family Arguments. Without clear instructions, your family might disagree about who should get what. This can lead to arguments and hurt feelings.
  3. It Might Take Longer and Cost More. Sorting out your things without a will can take a long time and cost more in legal fees. This can be hard on your family during a tough time.
  4. Your Kids’ Guardian Might Not Be Who You’d Choose. If you have young kids, the court will decide who takes care of them. This may not be the person you would have picked.
  5. Your Unmarried Partner Might Get Nothing. If you’re not married but have a partner, they might not get anything from your estate unless you have a will.
  6. It Can Be Harder for Stepchildren. Stepchildren usually don’t get anything unless you specifically include them in a will.
  7. No Control Over Special Items. Let’s say you have special things you want to give to certain people, like a family heirloom. Without a will, there’s no guarantee they’ll get it.
  8. Charities Miss Out. If you want to leave money to a charity, they won’t get it unless it’s in a will.
  9. More Stress for Your Family. Your family is already dealing with losing you. You don’t need to make them deal with a messy estate, go to court, sell your assets, and hire probate lawyers.
  10. Your Business Might Not Go to the Right Person. If you own a business, it might not be passed on the way you would have liked.

How Does Getting A Will Work?

Google Ads - Shawn & Luna

This is Shawn. You’ll be speaking with him throughout your whole process. Once you fill out the form, he will reach out to you to get started.

This is Melissa. She’s going to be your Chestatee will lawyer. Shawn will schedule an appointment for you to talk to Melissa. She will ask a few simple questions. From there, she creates the estate plan, has you review it, then you sign, and it’s complete!

So, how does the process look when you come to The Hive Law?

Here is what you can expect:

  1. First Meeting: We start with a meeting to learn about you, your family, and what you own. This helps us understand what you need.
  2. Getting Details: We’ll ask for information about your money, property, and who you want to leave them to. This helps us write a will that fits exactly what you want.
  3. Writing the Will: Using your details, we write a will for you. This will says who gets your things after you pass away.
  4. Checking the Will: You get to read the will to make sure it’s just right. If something needs to be changed, we’ll fix it.
  5. Signing the Will: Once the will is perfect, you sign it. We do this the right way to make sure it’s legally valid.
  6. Keeping the Will Safe: We keep a safe copy of your will and give you copies too. It’s important to keep your copy in a safe place.
  7. Updates If Needed: If things in your life change, like getting married or having a baby, we can update your will to match.
  8. Always Here to Help: Even after your will is done, we’re here for any more help or advice you might need.

How You Should Prepare

After you fill out the form, you’ll schedule your call with your attorney.

But, how do you prepare for that call?

What information and thoughts should you gather?

This list gives you a few ideas of where to start for our first conversation.

  1. Your Goals and Worries. Think about what you want from your estate plan. Think about who you want your assets to go to. Make sure to tell us what fears you have so that we can address those with your estate plan.
  2. List of What You Own. Know the basic stuff you own. Like, your house, any money in the bank, things you’ve invested in, and any business entities. You don’t need exact numbers, just a general idea.
  3. Family and Who Gets Stuff. Think about who you want to give your things to. This could be family, friends, or even charities. If you have young kids or someone who needs extra care, remember to think about them too.
  4. Papers You Already Have. If you already made a will or something like that, even if it’s old, tell your lawyer about it.
  5. Questions You Have. Write down any questions you want to ask. Like, how much it costs, how your lawyer talks to you, or special things about your stuff.
  6. Special Things About You. Be ready to talk about anything special. Like, if you own a business, have houses in different places, or have a mixed family.
  7. Who Will Help Manage Your Stuff. Think about who you trust to handle your things and make choices if you can’t, like who will be in charge of your will.
  8. How You Feel Talking to the Lawyer. Notice if you feel good talking to the lawyer. Do they listen? Do they make things easy to understand? Are they nice about your needs?

Who Needs An Attorney For Wills?

The easy answer is “everyone.”

But in reality, not everyone is going to get a will.

So, you should get one if you fall into any of these categories:

  2. Parents with Young Kids. You have little kids and need to choose who looks after them if you can’t.
  3. Business Owners. You own a business and want it taken care of the way you want when you’re not around.
  4. Anyone with Specific Wishes. You know exactly who should get your things and want to make sure it happens.
  5. People with Complicated Families. Your family situation is tricky, like if you’re divorced and want things shared fairly.
  6. Those Concerned About Taxes. You want to help your family pay less taxes on what they inherit.
  7. If You Want to Avoid Fights. You don’t want your family fighting over your money.
