Using Family Law Attorney Payment Plans

The three most common family law attorney payment plans are:

  1. Paying In Full
  2. Paying As You Go
  3. Using Family Law Attorney Payment Plans

Paying In Full

Paying in full is the least common family law attorney payment plan.

This is because every family law case is different.

This makes it hard to determine upfront how much your case will end up being.

For example, let’s say you want to file for divorce.

You may wish to have an uncontested divorce.

But your spouse may create issues that drag the divorce out.

This can cost thousands in extra attorney fees.

The family law attorneys who are able to provide this option are the ones who have flat fee divorces.

Paying As You Go

Paying as you go is the most common family law attorney payment plan.

It’s an hourly rate payment plan.

Let’s say that your divorce is going to cost you a total of $13,000.

Usually, this would look like something like:

  1. First Payment – Retainer Fee of $2,500
  2. Second Payment – $3,500
  3. Third Payment – $3,500
  4. Fourth Payment – $3,500

When you pay us upfront like this, we deposit the money into our law firm’s trust account.

The money is still yours.

And we are the trustees of the account.

We will work on your case and deduct fees from your balance until:

  • the case is complete
  • the funds are depleted (i.e., running out of First Payment above)

If there are any funds left over, we will refund that money back to you at the end of the case.

You can fund your hourly rate payment plan with cash or credit card.

Using Family Law Attorney Payment Plans

This is the most uncommon of the lawyer payment plans.

Divorce lawyers that take payments are not very common.

Most of them make you pay legal fees upfront to work on your case.

Or, if you are on a payment plan, it’s going to take forever to finish your case.

Let’s say that you’ve found a divorce lawyer that takes payments.

Your scenario looks like this:

  • Your uncontested divorce is going to cost you $5,000.
  • The divorce lawyer you found is charging $250 per hour.
  • You can only afford to pay them $500 per month.

In a scenario like this, they are only working on your case for 2 hours per month.

Your case is going to take 20 hours to complete.

$5,000 / $250 = 20 hours.

If they are only working on your 20-hour case for 2 hours per month, it will take 10 months to complete.
