  10. Get a new birth certificate to reflect the name change.

Adult Adoption Requirements

Adult adoption law requirements are far less restrictive than those involving a minor child.

  • Only the consent of the adoptee is required.
  • You do not have to terminate the existing parents’ rights of biological parents.
  • The biological parents need to get notified, but do not need to consent.
  • If the adult child is married, they should get spousal consent to the adoption agreement.
  • A home study is not required for adult adoption proceedings.

Can You Adopt Someone Older Than You?

No, you cannot adopt someone who is older than you.

No state allows you to adopt someone older than yourself.

Some states even require you to be 5-15 years older than the adult adoptee.
