What Is Asset Protection?

Asset protection is a way to keep your assets safe from lawsuits or creditors.

It involves legally arranging your assets so they are hard for others to claim.

This is things like money, property, and investments.

Our Suwanee asset protection lawyers will:

  • set up trusts
  • use legal entities like LLCs for businesses
  • set up insurance for extra protection

The idea is to protect your stuff while following the law.

It’s often planned before any legal issues happen.

Asset protection strategies vary based on individual needs and local laws.

What Asset Protection Services Include

Now you know what asset protection lawyers do.

So, let’s look at what our services include:

  1. Risk Assessment. Our lawyers first review your financial situation. We identify potential risks to your assets from lawsuits or creditors.
  2. Legal Structures. To protect assets, we may set up trusts or limited liability companies (LLCs). Each structure is chosen based on your specific needs.
  3. Retitling Assets. Changing ownership titles can protect assets. For example, moving a property title into a trust or an LLC.
  4. Exemption Planning. Our lawyers use laws that protect certain assets from creditors. This varies by jurisdiction but often includes retirement accounts and life insurance.
  5. Insurance. Adequate insurance coverage is crucial. This includes standard policies and specialized insurance for extra protection.
  6. Estate Planning. Asset protection is often combined with estate planning in Suwanee. This ensures your wealth is both protected and distributed as you wish.
  7. Regular Updates. Asset protection strategies need regular reviews. This ensures they remain effective over time.
  8. Legal Compliance. Our lawyers make sure all strategies are legal. Avoiding fraudulent actions is key.

Benefits Of Getting Asset Protection

You know you have assets that need protection.

You can’t leave them exposed to lawsuits, foreclosure, debt recovery, etc.

You can’t leave your personal belongings (your family’s home) exposed.

But other than the core issues asset protection solves, here are other benefits:

  1. Less Risk. It helps keep your property safe from legal problems like lawsuits, so you don’t lose them.
  2. Money Safety. Asset protection makes sure your money and things stay safe
  3. Keeping Your Business Safe. If you own a business, asset protection can help keep your personal stuff safe from business troubles.
  4. Peace of Mind. Knowing your things are protected can make you feel less worried. Especially if people sue each other a lot where you live.
  5. Protection from Debt. It can keep your things safe if you owe money or have to deal with bankruptcy.
  6. Privacy. Asset protection can keep your money matters private.
  7. Keeping Investments Safe. It helps keep your investments safe from unexpected legal problems.

How The Process Works

Google Ads - Shawn & Luna

This is Shawn. You’ll be speaking with him throughout your whole process. Once you fill out the form, he will reach out to you to get started.

This is Melissa. She’s going to be your Suwanee asset protection lawyer. Shawn will schedule an appointment for you to talk to Melissa. She will ask a few simple questions. From there, she creates the estate plan, has you review it, then you sign, and it’s complete!

After you fill out the form on this page, what happens?

That’s a great question!

Here’s an overview of what you can expect:

  1. Schedule Your Appointment. You’ll schedule a time that works best for you
  2. Understanding Your Situation. On our call, we learn about you – your family, what you own, and your wishes.
  3. Setting Goals. We discuss what you want to happen with your things and money after you’re gone.
  4. Reviewing Your Assets. We look at everything you own, like your house, savings, and any businesses.
  5. Discussing Family Needs. We discuss what your family will need in the future, especially if you have kids or someone who depends on you.
  6. Making a Plan. We help create a plan that says who gets what and when. This can include wills, trusts, and other legal papers.
  7. Asset Protection. We will make sure that your assets are protected from lawsuits and creditors.
  8. Choosing the Right People. You pick who will be in charge of carrying out your plan, like an executor for your will.
  9. Looking at Taxes. We find ways to lower the taxes your family might have to pay on what they inherit.
  10. Preparing Documents. We write all the legal papers to make sure your plan works the way you want.
  11. Reviewing and Signing. You check everything to make sure it’s right, then sign the documents.
  12. Keeping Things Updated. As things in your life change, we help update your plan so it always fits your situation.

How You Should Prepare

After you fill out the form, you’ll schedule your call with your attorney.

But, how do you prepare for that call?

What information and thoughts should you gather?

This list gives you a few ideas of where to start for our first conversation.

  1. Your Goals and Worries. Think about what you want from your asset protection plan. Think about how you want to separate your businesses and investments. Make sure to tell us what fears you have so that we can address those with your asset protection plan.
  2. List of What You Own. Know the basic stuff you own. Like, your house, any money in the bank, things you’ve invested in, and any business entities. You don’t need exact numbers, just a general idea.
  3. Family and Who Gets Stuff. Think about who you want to give your things to. This could be family, friends, or even charities. If you have young kids or someone who needs extra care, remember to think about them too.
  4. Papers You Already Have. If you already made a will or something like that, even if it’s old, tell your lawyer about it.
  5. Questions You Have. Write down any questions you want to ask. Like, how much it costs, how your lawyer talks to you, or special things about your stuff.
  6. Special Things About You. Be ready to talk about anything special. Like, if you own a business, have houses in different places, or have a mixed family.
  7. Who Will Help Manage Your Stuff. Think about who you trust to handle your things and make choices if you can’t, like who will be in charge of your will.
  8. How You Feel Talking to the Lawyer. Notice if you feel good talking to the lawyer. Do they listen? Do they make things easy to understand? Are they nice about your needs?
